Introduction
Welcome to bizlist.ai. These Terms of Service ("Terms") apply to all users ("Users" or "you") of our services. By purchasing or using our lists of leads, you agree to these Terms.
Description of Service
We provide lists of leads for businesses. These leads are based on indicators suggesting use of specific software and are enriched with publicly available data. The lists may include, but are not limited to, contact data like email addresses, phone numbers, and other related information.
Usage
Upon purchase, Users have the right to use the list however they see fit. There are no restrictions on the use of the information contained within the list.
No Refunds
Due to the nature of our product, all sales are final. Once a list has been purchased and delivered, we cannot offer refunds. This is because we have no way of ensuring the data hasn’t been duplicated or copied post-purchase.
No Guarantees
a. We cannot guarantee that the leads in our list currently use or have ever used the specified software, but our lists are compiled based on strong indicators that suggest so.
b. The activity status of leads in our list cannot be confirmed. Some contacts may be outdated or inactive.
c. The number of leads in our list is an approximation. While we make every effort to provide an accurate count, there may be occasional discrepancies, including the possibility of duplicates. Users should be aware that especially in cases where companies use multiple brand names, duplicates are more likely.
Liability
bizlist.ai (above the fold GmbH/LLC) will not be liable for any indirect, special, incidental, consequential, or punitive damages (including lost profits) arising out of or relating to these terms or the transactions they contemplate (whether for breach of contract, tort, negligence, or other form of action) and irrespective of whether bizlist.ai has been advised of the possibility of any such damage. In no event will bizlist.ai's liability exceed the price the User paid to bizlist.ai for the specific service provided.
Indemnification
Users agree to indemnify, defend, and hold harmless bizlist.ai, its affiliates, officers, directors, employees, agents, and licensors from any and all claims and/or losses incurred by any User or third party arising out of or related to its use of our lists of leads.
Changes to Terms
We reserve the right to modify these Terms at any time without notice. By continuing to use our service after such changes are made, you acknowledge and agree to be bound by the modified Terms.
Governing Law
These Terms will be governed by and construed in accordance with the laws of Switzerland, without regard to its conflicts of laws principles.
